Privacy Notice for California Residents

This notice applies to California residents and supplements our general Privacy Policy. It describes your rights under the California Consumer Privacy Act (CCPA) and how we handle your personal information.

About This Notice

This Privacy Notice for California Residents ("California Notice") is provided by Thomas Insurance Group Texas, LLC, doing business as Your Policy Insurance Agency ("Your Policy," "we," "us," or "our"), pursuant to the California Consumer Privacy Act of 2018 as amended by the California Privacy Rights Act of 2020 (collectively, "CCPA"). It applies solely to visitors, users, and others who reside in the State of California ("consumers" or "you").

This California Notice supplements our general Privacy Policy. Any terms defined in the CCPA have the same meaning when used in this notice. To the extent this California Notice conflicts with our general Privacy Policy, this California Notice controls with respect to California residents.

Insurance-specific exemption: Certain personal information that Your Policy collects as part of providing insurance products and services may be subject to the California Insurance Information and Privacy Protection Act (IIPPA) rather than, or in addition to, the CCPA. Where the IIPPA applies, it controls. This notice covers personal information collected outside of the insurance application and policy transaction context, as well as website usage data.

Information We Collect

We have collected the following categories of personal information from California consumers within the last 12 months. The table below also indicates whether each category was sold or shared for cross-context behavioral advertising, or disclosed for a business purpose.

We collect personal information directly from you (forms, quote requests, phone calls), automatically when you use our website (cookies, analytics), and from third parties such as insurance carriers, data verification providers, and publicly available sources.

How We Use Your Information

We use the personal information we collect for the following business and commercial purposes:

  • Providing, operating, and improving our insurance brokerage services and website
  • Processing insurance quotes, applications, and policy transactions on your behalf
  • Communicating with you about your policies, renewals, and coverage options
  • Analyzing website usage to improve user experience and service offerings
  • Complying with legal obligations, insurance regulations, and licensing requirements
  • Detecting and preventing fraud, security incidents, or illegal activity
  • Marketing our services to you where permitted (you may opt out at any time)

Sharing Your Information

We do not sell your personal information for monetary consideration. We do not share your personal information for cross-context behavioral advertising. We may disclose personal information to the following categories of third parties for business purposes:

  • Insurance carriers and underwriters — to obtain quotes, bind coverage, and service your policies
  • Service providers — IT, analytics, CRM, and communications vendors acting as data processors under contract
  • Regulatory and legal authorities — when required by law, subpoena, or to protect our legal rights
  • Business successors — in connection with a merger, acquisition, or sale of assets, with notice provided to you

All disclosures for business purposes are governed by written contracts that prohibit recipients from using personal information for purposes other than those specified.

Your California Privacy Rights

As a California resident, you have the following rights with respect to your personal information. We will not discriminate against you for exercising any of these rights.

Right to Know

Request disclosure of the categories and specific pieces of personal information we have collected about you in the past 12 months, including sources, purposes, and third parties we share it with.

Right to Delete

Request deletion of personal information we have collected, subject to certain exceptions (e.g., information needed to complete transactions, comply with legal obligations, or detect fraud).

Right to Correct

Request correction of inaccurate personal information we maintain about you. We will use commercially reasonable efforts to correct the information upon verification.

Right to Opt Out

Opt out of the sale or sharing of your personal information. As noted above, we do not currently sell or share personal information for cross-context behavioral advertising.

Right to Limit Use of Sensitive Info

Request that we limit our use and disclosure of your sensitive personal information to purposes necessary to perform our services or as otherwise authorized by law.

Right to Data Portability

Receive a copy of your personal information in a portable, readily usable format that allows you to transmit the information to another entity.

How to Submit a Request

To submit a verifiable consumer request, email our Privacy team directly:

Send your request to privacy@your-policy.com with "CCPA Request" in the subject line. Include your full name, California mailing address, and the nature of your request.

We Respond Within 45 Days

We will confirm receipt of your request within 10 business days and provide a substantive response within 45 calendar days. If we require additional time (up to 90 days total), we will notify you in writing.

You may submit up to two verifiable consumer requests within a 12-month period. We do not charge a fee unless your request is excessive, repetitive, or manifestly unfounded, in which case we will notify you in advance.

Verification & Authorized Agents

Identity Verification

To protect your information, we must verify your identity before fulfilling a consumer request. We will ask you to provide information that matches what we have on file (such as your name, email address, and state of residence). For requests to access specific data or delete data, we may require additional verification steps commensurate with the sensitivity of the information.

Authorized Agents

You may designate an authorized agent to submit a CCPA request on your behalf. Your authorized agent must provide written permission signed by you (or a power of attorney), and we reserve the right to verify your identity directly to confirm the authorization. Requests submitted by agents without proper documentation may be denied.

Non-Discrimination

We will not discriminate against you for exercising any of your CCPA rights. Unless otherwise permitted by law, we will not:

  • Deny you goods or services
  • Charge you different prices or rates for goods or services
  • Provide you a different level or quality of goods or services
  • Suggest that you will receive a different price or quality of goods or services

Sensitive Personal Information

The CCPA grants California residents specific rights with respect to "sensitive personal information," a defined category that includes Social Security numbers, precise geolocation, racial or ethnic origin, religious beliefs, and certain biometric and health data.

We limit our use and disclosure of sensitive personal information to purposes that are necessary to provide our services, comply with applicable law, or as otherwise permitted by CCPA regulations. We do not use sensitive personal information to infer characteristics about you beyond what is necessary for providing insurance services.

You have the right to direct us to limit our use of your sensitive personal information to that which is necessary to perform the services you requested. To exercise this right, contact us using the methods described in the "How to Submit a Request" section above.

Financial Incentives

We do not offer financial incentive programs (such as loyalty rewards, discounts, or other benefits) that involve the collection, sale, or sharing of personal information in a manner that requires disclosure under the CCPA's financial incentive provisions. If we introduce any such program in the future, we will update this notice and provide the required disclosures at the time of enrollment.

Retention of Personal Information

We retain personal information for as long as necessary to fulfill the purposes described in this notice, comply with our legal obligations under applicable insurance regulations (which may require retention for 5–7 years), resolve disputes, and enforce our agreements. When personal information is no longer needed, we securely delete or anonymize it in accordance with our data retention policies.

Retention periods vary by category of personal information and the regulatory requirements applicable to insurance records in each state. California residents may request information about our retention practices by contacting us as described below.

Updates to This Notice

We may update this California Privacy Notice from time to time to reflect changes in our practices, legal requirements, or regulatory guidance. When we make material changes, we will update the effective date at the top of this notice and, where required, provide additional notice (such as posting a prominent notice on our website or sending you an email).
